Pomona Deal: Harare Residents Give Local Govt Minister 48-hour Ultimatum To Withdraw Directive

The Combined Harare Residents Association (CHRA) has given the Local Government and Public Works Minister, July Moyo a 48-hour ultimatum to withdraw his directive to Harare City Council (HCC) with regards to the Pomona Waste-to-energy deal.

In his letter written on the 7th of July 2022, Moyo directed HCC to rescind resolutions which seek to suspend the contract between the local government authority and Geogenix B.V on Pomona Waste to Energy project.

Through its lawyer, Archford Rutanhira, CHRA wrote a letter on 18 July 2022 and directed it to Moyoaccusing him of interfering with the council’s resolutions on the Pomona deal. 

The letter, seen by Pindula News, wants the Minister to withdraw the directive, threatening to take him to court if he fails to do so. Reads part of the letter:

Your behaviour is especially regrettable in a country, which is founded on the principles of; the supremacy of the constitution; the rule of law; transparency, justice, accountability and responsiveness. The constitution calls upon the State and all institutions and agencies of government at every level to, in formulating and implementing laws and policy decisions, come up with policies that will lead to the establishment, enhancement and promotion of a sustainable, just, free and democratic society in which people enjoy prosperous happy and fulfilling lives. Your behaviour in the Pomona Waste to Energy deal would certainly be found wanting, in so many ways and at so many levels.

We are instructed to call upon you, as we hereby do, to cease and desist from interfering with the operations of the city of Harare and in that regard for you to withdraw your letter of the 7th of July 2022 within 48 hours of receipt of this letter. Failure to do so will result in our client approaching the honorable courts for relief.

CHRA reiterated that the principles and dictates of Devolution must be followed and any law or practice inconsistent with it is invalid.
